Restaurant GST Rates — 5% vs 18%

The GST rate for restaurants depends on the type and location of the establishment. Most standalone restaurants — whether AC or non-AC — pay 5% GST and cannot claim Input Tax Credit (ITC). Restaurants inside hotels with room tariffs above ₹7,500 per night pay 18% GST but can claim ITC on purchases. This choice significantly affects pricing strategy.

Cloud kitchens and delivery-only restaurants also fall under the 5% GST (no ITC) category. When food is delivered through Zomato or Swiggy, those platforms are responsible for collecting and remitting GST to the government since January 2022 — the restaurant receives the order value minus GST.

A Mumbai restaurant (standalone, AC) serves a table: Food ₹2,400, Beverages ₹600, Service charge 10% (₹300). Total taxable value: ₹3,300. GST at 5%: CGST 2.5% (₹82.50) + SGST 2.5% (₹82.50) = ₹165. Total bill: ₹3,465. Note: Service charge is voluntary per CCPA guidelines and must be disclosed upfront.
